The magazine 'Time' claimed on its front page that Infanta Elena had alleged in her petition for divorce that her ex-husband Jaime de Marichalar "used cocaine occasionally." Since that time, the magazine and exduque were involved in a war court has been postponed until now.

The magazine won because they didn't accuse Jaime Marichalar of 'occasional use of cocaine', they only speculated that Elena had alleged in her petition for divorce that her ex-husband Jaime de Marichalar "used cocaine occasionally and didn't say it was a fact that Elena did either. It seems the Spanish law is very loose for 'freedom of speech', press can spread any type of rumors, even it means character assassination and wouldn't get any punishment, that's rather sad.

Couldnt the petition be used to dismiss such rumours (I guess in case Elena really claimed in her petition that Jaime is an occasional drug user it would be true) - being labelled a drug user is a serious allegation.
